Terms of Service

1. Acceptance of Terms

By accessing, registering for, and using PingStag ("the Service", "we", "our"), you accept and agree to be bound by the terms and provisions of this agreement. If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these terms. If you do not agree to abide by these terms, you are strictly prohibited from using or accessing our platform.

2. Description of Service

PingStag is an enterprise-grade infrastructure monitoring tool that tracks website uptime, REST APIs, TCP Database ports, SSL certificates, Cron Jobs, and domain expiry dates. While we utilize distributed global edge nodes and highly concurrent backend architectures to strive for maximum accuracy, PingStag provides this service on an "as is" and "as available" basis without absolute guarantees of uninterrupted functionality.

3. User Accounts & Responsibilities

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during the registration process.
• Maintain and promptly update your account information to keep it accurate.
• Maintain the security and confidentiality of your login credentials and API keys.
• Be fully responsible for all activities that occur under your account, including actions taken by invited team members in your workspace.

5. Acceptable Use Policy (AUP)

PingStag provides high-frequency infrastructure monitoring. You agree to use the service ethically, legally, and responsibly. You explicitly agree that you will NOT:

• Monitor websites, APIs, TCP ports, or infrastructure that you do not own, operate, or have explicit legal authorization to monitor.
• Use the high-frequency pinging features to conduct Distributed Denial of Service (DDoS) attacks, stress-testing, or malicious polling.
• Attempt to reverse-engineer, exploit, or bypass the platform's rate limits, WAF detection rules, or Edge verification networks.
• Upload or transmit any malicious payloads, unauthorized scripts, or illicit data via our API POST monitoring configurations.

Violation of these terms will result in immediate, permanent account termination without a refund, and may be reported to appropriate international law enforcement authorities.

6. Intellectual Property Rights

All content, features, functionalities, original code, UI/UX design, and logos provided by PingStag are the exclusive property of PingStag Inc. and are protected by international copyright, trademark, and intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent.

7. Indemnification

You agree to defend, indemnify, and hold harmless PingStag, its parent company, officers, directors, employees, and agents, from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms of Service; or (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right.

8. Limitation of Liability

In no event shall PingStag, its directors, employees, partners, or suppliers, be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, without limitation, loss of revenue, lost clients, loss of data, loss of goodwill, or any other intangible losses resulting from (i) your reliance on our alerts; (ii) missed or delayed downtime alerts; (iii) the inability to access the Service; or (iv) any unauthorized access to our secure cloud servers.

9. Modifications to the Service & Pricing

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. Prices of all subscriptions are subject to change upon 30 days' notice from us. Such notice may be provided at any time by posting the changes to the PingStag dashboard or via email notification.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the applicable jurisdiction, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
